Court dismisses N1.5m damages suit against Sudo Pee Supermarket

A High Court in Makurdi on Monday dismissed a suit filed by a businessman, Tarlumun Shimave, claiming N1. 5 million in damages from the owners of Sudo Pee Supermarket.

Shimave through his Counsel D.O. Penda had dragged the owners of the supermarket, Steve Akange and his wife, Priscilla, claiming that he lost N1 million in the premises of the supermarket.

The plaintiff claimed it was negligence of the defendants’ servants to safeguard his car that led to the loss.

Delivering judgment, Justice Theresa Igoche, held that the evidence before her showed that the plaintiff did not provide any credible evidence that the two security men on duty at the supermarket were negligent.

Justice Igoche held that the owner of the supermarket, Akange did all he was expected by providing security.

”The claim by the plaintiff that he withdrew the said money from First Bank Makurdi on the faithful day and drove straight to the supermarket, parked and went inside to shop, and as such the defendant be held responsible does not hold water.

”This matter is hereby dismissed in its entity,” she held (NAN)
