Businessman arraigned over alleged sale, distribution of fake wine

Lagos, Feb. 27, 2026 (NAN) A businessman, Donatus Ofoelo, on Friday, appeared before a Federal High Court in Lagos, for allegedly aiding importation and distribution of unwholesome processed food.

The defendant was charged by the National Agency for Food and Drugs Administration and Control (NAFDAC), on a three-count charge bordering on aiding the manufacture, distribution and sale of unwholesome processed food.

Ofoelo, however, pleaded not guilty to the charges.

After his plea, the prosecutor, Mr Bartholomew Simon, urged the court to remand the defendant pending trial.

Meanwhile, the defense counsel informed the court of a bail application of the defendant, and urged the court to grant the defendant bail on liberal terms.

Justice Akintayo Aluko, consequently, granted the defendant bail in the sum of two million naira, with one surety in like sum.

The court held that the surety must either be a civil servant of grade level 12, or the owner of a registered landed property in Lagos.

The court, consequently, adjourned the case until June 11, for trial.

According to the charge,  the defendant allegedly committed the offence on Jan. 30, at shop 63, Balogun St. and TA44/45 Balogun Ultramodern Shopping Mall in Lagos.

The prosecutor alleged that the defendant aided one Austine Odumodu and one Ezeoba Ekwelie, both now at large, to sell unwholesome processed food including Casamigos Tequila wine.

The defendant was alleged to have aided them to sell the fake products by his illegal acts of importation, sale and distribution of Casamigos Tequila packaging materials, empty bottles and cork, with the assistance of one Mrs Akunne Obianuju who now resides in China.

The offence contravenes the provisions of section 1(c) of the Counterfeit and Fake Drugs and Unwholesome Processed Foods (Miscellaneous provisions) Act, Cap C34, Law of the Federation 2004. (NAN)(
