A Grade ‘A’ Customary Court in Ibadan on Thursday dissolved the 30-year-old marriage between one Abosede Fasoyin and her estranged husband, Isola Fasoyin on grounds of irresponsibility.
Delivering judgment, the court president, Mrs S.M. Akintayo, held that she arrived at the decision to grant a marriage dissolution, following unwillingness of the petitioner to continue waiting endlessly.
“Therefore, the 30-year-old union between Abosede and Fasoyin is hereby, dissolved in the interest of peaceful living.
“Since the three children produced by the union are now grown up, they are each free to stay with whoever pleases them,” she said.
Earlier, the petitioner had told the court that she filed the suit because the respondent abandoned her for the past five years, leaving her to wallow in penury and hunger.
“My lord, not only did Fasoyin desert home, he also refused to take any form of responsibility of the children and I.
“Despite the fact that I reported the incident to his parents especially his father, nothing was done to bring him back home.
“In fact, we don’t know his whereabouts and that is the reason why the bailiff served him by substituted means, pasting it on his family’s house door.,” she said
According to her, the respondent performed all necessary marital rites on her on Oct. 3, 1996 following payment of the required N5,000 bride price and presentation of gifts.
She added that the respondent’s disposition gradually worsened with time adding that for over five years, he kept away from his matrimonial home without any tangible reason.
Meanwhile, the respondent was not in court when he was called to begin his defence.
From the court’s record, the bailiff had served several substituted hearing notices on Fasoyin, but he failed to appear in court to defend the case. (NAN).
