Man denies wife right to seek Khul’i, says marriage solemnized in court

A married man, Sulaiman Ahmad on Thursday challenged his wife Ruqayya Mustapha, the right to seek divorce through Khul’i, saying they got married at Magistrate court in Kaduna.

The man made the preliminary objection through his counsel A.A Abdulmalik after his wife prayed a shari’a court in Kaduna to grant her divorce through Khul’i, a type of divorce where a woman returns the dowry she received.

Abdulmalik added that the complainant had taken the marriage certificate while leaving her matrimonial home praying court to give them time to recover the document and formally present it in court.

Earlier, she told the shari’a court that she was not interested in the marriage because her husband betrayed her trust.

She explained that their marriage did not take place in any court, adding that she received N50,000 dowry and was ready to return it.

She prayed court to compel the defendant to present wedding pictures and witnesses to support his claim.

The Judge Mallam Mu’awiyya Shehu, after listening to both of them adjourned to August 13 for the defendant to present the document and witnesses.(NAN).
