Court discharges, acquits man, 34, of murder case in Ekiti

An Ado-Ekiti High Court, on Wednesday, discharged and acquitted a 34-year-old man, Oluwafemi Olotu, of murder case.

 

Olotu had, on Sept. 30, 2019, been alleged to have murdered one Abigail at Iyin Ekiti.

 

His alleged offence was said to have been contrary to Section 316 and punishable under Section 319(1) of the Criminal Code Law, Cap. C16, Laws of Ekiti State, 2012.

 

To proof his case, the Prosecutor, Taiwo Ariyo, had called two witnesses and tendered statements of the defendant and a cutlass as exhibits.

 

The defendant had spoken through his counsel, Kayode Oyeyemi, who addressed the court on a no-case submission in favour of his client.

 

However, in his judgment, Justice Bamidele Omotoso discharged and acquitted Olotu.

 

“I am satisfied that there is no legally-admissible evidence linking the defendant with the commission of the alleged offence with which he had been charged and which would have necessitated his being called upon for his defence.

 

“No reasonable court or tribunal can act on it as establishing the criminal guilt of the defendant in the instance case,” the judge said.

 

He consequently upheld the no-case submission of the defendant’s counsel, adding: “the defendant is accordingly discharged and acquitted.” (NAN)
